The arbitration shall be conducted in Searcy, Arkansas, United States, and judgment on the arbitration award may be entered in any court having jurisdiction.

You agree that any arbitration will be conducted on an individual basis and not as a class action, collective action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm, without first engaging in mediation or arbitration.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Arkansas, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms of Use shall be brought exclusively in the federal or state courts located in White County, Arkansas, and you consent to the personal jurisdiction of such courts.
